Conditions of Hand Slaughtering

Islamic jurisprudence specifies which foods are halāl (حَلَال “lawful”) and which are haram (حَرَامْ “unlawful”).

This is derived from commandments found in the Qur’an

Muslims are allowed to eat the meat of the following animals:

Domesticated birds

Camels – Cow – Sheep – Goats – Deer

Muslims will only be allowed to consume the meat of the aforementioned animals if:

A person, who slaughters an animal, must be a Muslim.

At the time of slaughter the slaughter man recites, the name of Allah by saying “I begin with Allah’s name and Allah is the Greatest,” or at the very least, “I begin with Allah’s name.”

The method of slaughtering an animal is that the four main arteries of its neck should be completely cut (jugular artery, food pipe, jugular vein and windpipe).

It’s recommended, when an animal is slaughtered, it should be facing Qibla. ( head, chest and belly or If the animal is sitting or standing or lying on its left or right side , must be facing Qibla )

*** If the slaughter man is Shia Muslim, the 4th condition is a MUST  

Conditions of Hunting

Islamic jurisprudence specifies which foods are halāl (حَلَال “lawful”) and which are haram (حَرَامْ “unlawful”).

A wild animal whose meat is halal to eat becomes Clean (Tahir/pak) and halal to eat by hunting if it is capable of running away or flying. Based on this, the young one of a deer or partridge which cannot run away or fly, do not become Clean (tahir/pak) and halal to eat by hunting.

If a wild animal like deer, partridge and wild goat whose meat is halal to eat, or a halal animal which was a domestic one but turned wild later, like, a cow or a camel which runs away and becomes wild, is hunted in accordance with the laws which will be explained later, it is Clean (Tahir/pak) and halal to eat. But, a domestic animal like sheep and fowl whose meat is halal to eat, or tamed wild animal whose meat is halal to eat does not become Clean (Tahir/pak) and halal by hunting.

If Halal wild animal is hunted with a weapon and it dies, it becomes halal and its body becomes Clean (Tahir/pak), if the following five conditions are fulfilled:

  • The weapon used for hunting should be able to cut through, like, a knife or a sword, or should be sharp like a spear or an arrow, so that due to its sharpness, it may tear the body of the animal. If an animal is hunted with a trap, or hit by a piece of wood or a stone, it does not become Clean (Tahir/pak), and it is haraam to eat its meat.
  • If an animal is hunted with a gun and its bullet is so fast that it pierces into the body of the animal and tears it up, the animal will be Clean (Tahir/pak) and halal, but if the bullet is not fast enough and enters the body of the animal with pressure and kills, or burns its body with its heat, and the animal dies due to that heat, it is a matter of Ishkal to say that the animal is Clean (Tahir/pak) or halal.
  • The hunter should be a Muslim or at least Ahle Kitab. If the person, who is classified as Kafir, hunts an animal, the animal is not halal.

 

  • The hunter should aim the weapon for hunting the particular animal. Therefore, if a person takes an aim at some target, and kills an animal accidentally, that animal will not be Clean (Tahir/pak) and it will be haraam to eat its meat.

 

  • While using the weapon the hunter should recite the name of Allah, and it is sufficient if he utters the name of Allah before the target is hit but if he does not recite Allah’s name intentionally, the animal does not become halal. There is, however, no harm if he fails to do so because of forgetfulness so the animal will be haram if the hunter reaches it when it is already dead, or, even if it is alive, he has no time left to slaughter it and if he has enough time to slaughter it and he does not slaughter it till it dies.

Conditions of Fishing

Islamic jurisprudence specifies which foods are halāl (حَلَال “lawful”) and which are haram (حَرَامْ “unlawful”).

Fishing Condition

If a fish with scales is caught alive from water, and it dies thereafter, it is Clean (Tahir/pak) and it is halal to eat it, even if the scales are shed off later due to some reasons.

If it dies in the water, it is Clean (tahir/pak), but it is haraam to eat it.

It is lawful to eat it if it dies in the net of the fisherman.

A fish which has no scales is haram even if it is brought alive from water and dies out of water.

If a fish falls out of water or a wave throws it out, or the water recedes and the fish remains on dry ground, if someone catches it with his hand or by some other means before it dies, it will be halal to eat it after it dies.

It is not necessary that a person catching a fish should be a Muslim or should utter the name of Allah while catching it.

If a fish is cut into two parts out of the water, and one part of it falls into the water while it is alive, it is halal to eat the part which has remained out of the water, and the recommended precaution is that one should refrain from eating it.

Conditions of Machine Slaughtering

Muslims will only be allowed to consume the meat of the Domesticated birds if it’s mechanized slaughter process by following below steps:

In a mechanized process, the person (s)/Blessers who starts the machine is considered the slaughterer (ZABIH), must be a Muslim.

According to the fatwa, the person who starts the machine is considered the slaughterer (“zābiḥ”), and he should be the same person who says the tasmiyya (bismillah) when the birds are being slaughtered

Blessers are required to be stationed in front of the slaughterer machine at the start of processing and recite blessing continuously throughout the production shift.

whenever the person (s)/Blessers takes the break, a replaced person who was involved in starting the machine would say tasmiyya in his place and to be considered as “Slaughterer (ZABIH)

Additional Blessers are positioned downstream of slaughter machine and visually inspect{s) the birds to ensure that all birds are properly cut and if not, manually cut{s) the neck as per slaughtering condition

It is required that the bird is to be alive at the time of slaughter to be considered Halal

Its recommended when an animal is slaughtered, it should be facing Qibla. 

If the slaughter man is Shia Muslim, the 9th condition is a MUST.

If for an any reason slaughter happened without the presence of a Blessers or slaughtered NOT in a way of cutting that explained in 6th then the birds will be considered non-halal and inspector will takes it out.  

During the inspection, the HMO Inspectors will confirm that the birds are still alive after the stunners on selected birds
